USA: Alliant’s FAQ for the Week: February 19th

Asinta’s US Partner, Alliant publishes a Frequently Asked Question every week. Here’s one from the week of February 19th 2016 regarding eligibility for healthcare plans for an employee’s spouse.

Q: My client’s employee has a spouse that does not have a social security number. Are they still eligible to participate in the employer’s health plan?
A: The plan document will determine who is eligible, but having a Social Security number as a condition to spousal eligibility is almost never seen, and could presumably raise other legal issues. In most cases, a spouse without a Social Security number should be treated the same as any other spouse when evaluating eligibility. The plan document and/or carrier/TPA are your best resources in this case.
