Spain’s New Transgender Law

Spain's new transgender lawEquality for trans people became effective on March 2, 2023, through Spain’s new transgender law that guarantees the rights of lesbian, gay, bisexual, trans and intersex people (LGTBI). The goal is to eradicate discrimination to ensure that sexual identity, gender expression, sex characteristics, and family diversity can exist in Spain with complete freedom.

Employer Obligations

Employers with more than 50 workers must have, within twelve months of the effective date for this law, a planned set of measures and resources to achieve real and effective equality for LGTBI employees, which includes an action protocol for dealing with harassment or violence against LGTBI staff. To this end, the measures will be agreed upon through collective bargaining and with the workers’ legal representatives. Employers must also perform the following:

  • Develop a code of ethics and protocols that include protection measures against any discrimination on the grounds provided for in this law.
  • Implement measures that favor the integration and labor insertion of trans people.
  • Include trans people in the preparation of equality and non-discrimination plans, with particular attention given to trans women.
